Hey everyone. Steve Kasperzyk and Mike Ortiz of Total Mortgage, back here today with another special guest, attorney Jason Morytko of Real Estate Law Group. Jason has been practicing real estate law since 2011, and is here to answer some questions about the buying process. Thanks for having me, guys. Anytime! So Jason, what exactly is the role of a real estate attorney on a purchase here in Connecticut? An attorney plays a few different roles in a transaction. One would be to protect the client’s rights. We want to make sure whether it’s contract negotiations or any other time throughout the process that their rights are always protected and somebody’s looking out for them. Number two would be a title search. We want to research the property that the client is buying and make sure that there’s no outstanding liens when they become the owners. And lastly, it’s to work with the lender. To make sure all documents are executed correctly, and everybody’s happy with the new home. Is there any up-front cost for your services? My office does not charge anything up-front for a client. Your closing costs typically are referred to as an attorney fee, which is included in the closing costs so the lender has likely warned the client up front about it, so there’s no surprises at closing, and the fee is only due if the closing happens. When should a potential buyer first contact you? My advice to people is to contact me the sooner, the better. It’s a one fee for the entire transaction, so why not get as much legal advice as you can, so you’re informed through every step of the process. So what are key factors someone should look for when hiring a real estate attorney? I would say the most important two key factors when hiring an attorney is responsiveness and experience. You want somebody who just does real estate, and you also want somebody who’s going to get back to you when you have a question. Buying a home is probably the largest financial purchase you’re going to make in your life, so you want to make sure you get answers to your questions right away so there’s no trouble down the road.
