when it comes to evicting tenants
every landlord must follow applicable state and local laws by
providing proper notice to the tenant and following the
procedures necessary for illegal eviction even if a tenant is
late paying the rent or has violated some rule laid out in his or her lease a landlord usually has the duty to follow the process which includes legally ending
the tenancy before suing to evict the tenant the
first step for the landlord is to give the tenant
written notice that for example the tenant has not paid the rent or has done
something in violation of the lease agreement like
putting an old junk car in the front yard the tenant then has the option to fix or cure the violation within a set amount
of time before the landlord ends the tenancy and then presumably
sues for eviction some notices may not give
the tenant the opportunity to fix a problem maybe the tenant has
done something illegal or has continually violated the lease in some states the
landlord has the right to end the tenancy without giving the tenant the option to fix a problem but must still
give the tenant notice a landlord can never force an eviction by
just changing the locks and putting the tenant’s belongings out on
the street if the tenant refuses to leave the landlord will have to file an
eviction lawsuit in the local court and must serve the
tenant with the proper summons and complaint
during the eviction lawsuit the tenant will have the opportunity to
defend him or herself perhaps the tenant didn’t make that rent
payment because here she had to make necessary repairs
to the property the tenant might also point out any errors in the eviction paperwork causing
the court to dismiss the eviction lawsuit until
the landlord has jumped through all these legal hoops the tenant cannot legally be evicted

Any one can give an information regarding the fact that after tenant not paying rent for 3 month and you file the eviction process you received a letter form the Company by the name "BASTA", asking to settle by given $3,500.00 plus 45 days additional days.  Is that a legal way to proceed.  To me that sound as Extortion.  This situation is very common her in the Antelope Valley.

  4. HeEeLP! What if… (in cliff note form mind you) 1; stellar rental history for almost 3 years.
    2: PROMPTLY after I needed a plumber, due to $450.00 water bill due to something like a valve not functioning correctly, (which I have received NO form of reimbursement)
    3: loss of toilet for 4 days, & some other minors. sending men over with NO permits, or even work out of a business, my property mgr works for the 5TH "best" real estate co. "Realty One" came to her office every month to pay her..& ONLY her, no cash, no debit cards, come to find that this "agent' handled my & other rental properties but is not affiliated with "One"!? 30 day notice, absolutely assumable due to landlord retaliation! ALL the while, my health being quite attacked, & sick. (still never late on payment) now UPON this 30 no reason notice I am unable to reach her to take payment (July1-31) OBVIOUSLY making it look as if I am late!! after MANY attempts to give payment, a text was sent to me by landlord saying that "some" "Diana" will be taking this on..WHO!? You want me to send a m.o. via mail to someone I have NO knowledge of? thanks for the rant, I am sick, & sick & tired!? Advice please! 🙂

OTHER PEOPLE AND PETS LIVING ON THE PROPERTY, NOT MAINTAINING THE PROPERTY AND TRASHING IT, AND NOT PAYING THE RENT, TRIGGERS A 3 DAY EVICTION NOTICE, THEY DONT MOVE OUT THEN I HAD TO FILE TO EVICT. I DONT HAVE THE FUNDS TO KEEP EVICTING THEM WHILE THEY APPEAL IT AND REMAIN IN MY HOUSE, IM GOING TO SELL THE ENTIRE PLACE TO GET RID OF IT IM DONE AND SICK OF THIS MESS
