A partition suit is a suit in equity
that means that the court has various remedies that they can come up with when you are seeking a partition. The first remedy is known as a partitioning kind –
this is a physical partition of the property this works best if you have
acreage; perhaps there’s a stream running down the middle – that is a partition in
kind, where the court will give one property owner half the property and the
other property owner the other half maybe it’s not exactly equal but they’ll
work they’ll work out a remedy The second remedy is known as partitioned by allotment – now this means that the court will force one party to buy the other
out and that is a partition by allotment and the third one which most people are
interested in is a partition by forced sale that’s where a Special Commissioner
is appointed and then the property is sold to a third party. These cases tend
