How To Hire A Great Attorney


Is attorney Mike Gravlin and welcome to law talk and today we’re gonna answer the very important question How do I hire a great attorney? I’ve been a litigator here for over 20 years in my background has been mostly personal injury and workers compensation for the past few years and I have a very good idea of how a good attorney and client relationship was formed Now hiring an attorney is a little bit more of an art than a science there’s a lot of feel to it, but there are definite guidelines and things to go by and there are two Absolutely critical factors that you need to take into account before you hire an attorney Before we get to those factors. I’m going to talk about a few factors that really don’t matter but sound like they should Let’s start with with the first one advertising if you see a lawyer on TV That does not mean they’re good or bad or anything else. It just means they’re advertising it Literally has zero. I know great attorneys to advertise in a horrible attorneys who advertise It just is not a way to separate the good from the bad That that factor alone a lot of the attorneys that advertise really aren’t going to be your attorney They’re the referring those cases though, but a lot of them are so I don’t even want to That’s just simply not a good metric to use to decide whether or not this attorney is right for you the second factor that I really think doesn’t matter as Awards you there’s a lot of awards in every industry law is no different and Frankly a lot of them don’t mean much They can from time to time if you’re in the industry, you can sort of pick that out a little bit better, but mostly they don’t mean much and It’s it be harder to determine if that’s a good factor than that’s worth your time to do so I just wouldn’t pay much attention if somebody’s named on a list or something that maybe because they’re awesome It made me because they paid money to be named on the list. It’s that simple So it’s just not a good factor to decide once again, like advertising. I know I know You know, I have a few words as a every attorney does I Get a great attorneys who have them and horrible attorneys who have them so it’s simply not a way to separate the good from the bad and You know what you’re looking for is is this personally good and the Representation of me and my issue and it’s just not a good way to determine The third one is a little trickier. It seems like it would be a real good idea, but it I don’t think it’s very determined of whether or not someone’s a good attorney And that is where they went to law school or where they went to Undergrad it in order to be an attorney with it with the exception of you right in the states You have to go to college and then you have to go to law school. So That’s gonna be on the resume somewhere But as well get to the the two factors that come up you’ll see that you’re usually not hiring an attorney directly out of law school, so What’s much much more important as in practice for years, what’s the reputation they’ve developed how have they? What have they learned in the specific practice area? that you’re looking for that that’s that’s gonna mean a lot more than then the You know law school, they went to or the undergrad school. They went to or their their prior degrees or anything else like that And it’s just again not a great factor I mean I’m litigating with with attorneys every day knowing I don’t really know most of the time but if I do hear what’s cool I don’t think a thing of it. I know Good and bad attorneys from every sort of institution and Really just matters a lot more and what you’ve learned while you were practicing unless you’re fresh out of school Maybe it would make a difference but really They’re fresh out of school is not an attorney wanna hire I have one more factor that actually does not matter much but it matters a little and that is location and that can really depend on the type of representation so if if they’re able to do what you need to do is save a real estate closing and they can get to the To the closing and it really doesn’t matter if they’re close or not You’re probably not going to go to their office lot, but that representations we know with the email just as an example In a personal injury case. It’s probably good If you have somebody who’s familiar with the judges in the jurisdiction, that’s probably true in any type of case These are general principles or really applies to anybody However, there are some exceptions if you’re let’s say in a small town you may not have a really good personal injury attorney because it just simply is enough population to support one so you probably have to Go to the next nearest town to get somebody who is good Or maybe there just happens to be a really good one there who does sort of a general practice but happens to be very good at it Those are the types of things you’re looking for, but location can make some difference however in this day and age there’s not a lot of Constant going to the attorney’s office There is if you’re going to in my circumstance for going to trial the positions that sort of thing but you’re gonna have to travel for that anyway, so what location can matter but usually doesn’t Ok now we’re down to the two factors that really do matter this is what you want to make a Decision and like I say it’s more of an art than a science But the first one is experience now, what’s hard about that is? It’s hard for you to evaluate unless you’re an attorney what the attorneys experience is But let’s start with the third, you know if they graduated last week They don’t have a lot of experience. You can tell that much the other one. The other thing you can do there is certainly Referrals, yes for friends or people who know them there were the reputation in talent if you were if you have access to that sort Of information. That’s usually That’s that’s more helpful than the other factors. I’ve listed that that’s a better thing to do Is to ask people and certainly if you know somebody who is represented by an attorney and they recommend them so they’re really good That’s that I think is a very appropriate Positive sign that that’s a good attorney for your situation and Experience what you want to determine is that they have experience specifically doing what you want them to do So they could have been in practice for thirty years, but if they’re doing transactions and you want a trial attorney That’s not gonna work. You want someone who’s been doing trials? If you you know or conversely so they do You really want specifically some experience now that there’s there’s a limit on that It’s just not like you know, the the longer you better practice the better you are that varies by by attorney but you want some some level of experience and Specifically experience with the type of issue that you have if possible That leads us to the second factor Which is probably the most important and I’m giving you this from my years of experience and having represented thousands of people in various circumstances This is probably the most important factor Assuming someone has some competence in the area that you an experience in the area that you’re looking for Its compatibility and the only way you can really determine that and you can’t be sure about it But the only way can really determine that is to talk to the attorney a lot of these representations become Personal because you have to do you have to divulge personal information. You may have to talk a lot It’s hard to tell upfront some things will Sail through real quickly, but you’re not sure. Maybe this is a case that That needs to go to trial and is kicking around for four years and you really have to talk a lot Well you want that to be with the person that you can get along with and respect and work Well with that relationship is huge now you it’s hard to determine that from just an interview But it’s better to talk to them than not You your gut is a good guide in this circumstance. If you have a sense this person knows what they’re doing and Communicates with you well, and you feel comfortable That’s the best you can do That is your best indicator is how do you get along with them? Not not do their own best friends or something like that. But do I respect them? Do I think that they’re competent do I feel? confidence that this person can work with me and Complete the job. It’s that simple. So those are the two biggest factors our experience and compatibility and if you did that those are sort of Subjective, but I think the only way you can really kind of know that is by is by having a conversation with the prospective attorney that you want to hire and these sorts of Principles really apply to any type of attorney That I can think of it’s really not limited to my practice areas or anything else and I hope that is helpful in the past I did a video on For red flags that you’ve hired the wrong attorney You’re about to hire the wrong attorney and I’ll I’ll put that up there So, you know, obviously this dovetails with that.
